In connection with the Services, you may purchase, activate, access, or otherwise use a Ride Pass, which is subject to these terms and conditions, as may be amended, and Lime’s User Agreement, the terms and conditions of which are expressly incorporated by this reference (together, the “Ride Pass Terms”). Any undefined, capitalized terms will have the meaning set forth in the User Agreement. Ride Passes are offered to you by the Lime entity who provides you with Services under your User Agreement.
Ride Pass offers you the ability to purchase bundled benefits (e.g., unlocks, rides, discounts, and/or minutes) in select markets (“Offer”). When you buy a Ride Pass, you agree to these Terms, as well as the specific terms of the Offer. Each Offer will include important details and terms, such as where and when a Ride Pass may be used, the benefit(s) conferred by the Ride Pass (e.g., whether starts/unlocks are included in the Ride Pass and the total number of eligible starts/unlocks, minutes, and/or rides for each Ride Pass, or the maximum duration of each eligible ride) (“Ride Pass Benefits”), and the cost of the Ride Pass (“Rate”). Please refer to your Offer for details before purchasing the Ride Pass. Standard unlock fees, ride fees, and/or per minute fees apply after the Ride Pass Benefits are exhausted. A Ride Pass may include minutes that you can use with the corresponding Ride Pass service (“Riding Minutes”). If the Ride Pass includes Riding Minutes, they apply to each eligible ride taken within the time period identified in the Offer, up to a cumulative total number of minutes not to exceed the Riding Minutes identified in your Offer. Partial minutes are rounded up to the nearest whole minute. In the case of a reserved ride, a reservation fee applies unless the Ride Pass includes free reservations for the duration stated on the Offer at the time of purchase.
Ride Pass has no cash value and is non-transferable. Ride Pass is not eligible for refunds or credit, whether used or not, unless set forth in these terms or as required by applicable laws. Ride Pass is valid only in the country where purchased. Ride Pass is valid on Lime-owned electric scooters, electric bicycles, and electric mopeds, except in the event the Offer expressly excludes a vehicle type from the Ride Pass. Ride Pass may not be available in all regions or to all users. Ride Pass cannot be combined, stored, or transferred, and is not valid with Lime Access, Group Rides, or with promotion codes or other discounts. Lime reserves the right to revoke a Ride Pass if a Lime account has been flagged for suspicious or fraudulent activity. Lime may update these terms at any time. Any material changes to these terms will be communicated to you. Subject to applicable law, when accessing or using the Services, you will consent to be bound by these terms, as amended at the time. You are free to stop using Ride Pass and/or the Services at any time.
Right of Withdrawal. You have the statutory right to withdraw from the Ride Pass within 14 days from the day of the activation of the Ride Pass, without providing any reason.
To exercise the right of withdrawal, you must inform Lime (LimeBike Germany GmbH, Herzbergstraße 22, 10365 Berlin, Germany, Telephone: +49 (0) 69 7704 4733, Email: [email protected]) of your decision to withdraw from the Ride Pass by an unequivocal statement (e.g. a letter sent by post or email) before the 14-day withdrawal period has expired. Alternatively you may use the model withdrawal form attached as the appendix, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the 14-day withdrawal period has expired.
We will reimburse you without undue delay and in any event not later than 14 days from the day on which we receive your withdrawal notice. We will use the same means of payment as you used for the transaction, unless you expressly agreed otherwise; and you will not incur any fees for such reimbursement. If you used any part of the Ride Pass during the 14-day withdrawal period, this use constitutes an express request by you to have immediate access to the Ride Pass, and you may be required to pay an amount in proportion to the minutes used through the date we received your withdrawal notice.
